Common questions and facts

What is a mobile public notary?

A notary is simply an impartial witness to the taking of acknowledgements and/or affidavits, the signing of documents and administering oaths. To become an officer of the state, a notary public must complete and pass a curriculum as well as a state standardized test.

Do I really need a notary?

Common instances where a Notary is required include real estate transactions, wills, powers of attorney, affidavits, and certain business agreements. Notarization adds a layer of trust and integrity to these documents, as it ensures that the parties involved are aware of the legal implications of their actions.  The most common function of the notary is to prevent fraud by attesting that a person actually signed a document. To do so, the notary will take acknowledgments of deeds and other instruments or administer oaths. Notarization is the act of witnessing by the notary public in accordance with California state law.

What is an acknowledgement?

In law, an acknowledgment is a declaration or avowal of one's own act, used to authenticate legal instruments, which may give the instrument legal validity, and works to prevent the recording of false instruments or fraudulent executions. Acknowledgment involves a public official, frequently a notary public

What is the purpose of an acknolegement?

The purpose of an acknowledgment is for a signer, whose identity has been verified, to declare to a Notary or notarial officer that he or she willingly signed the document. This acknowledgment wording is mandatory for all acknowledgments taken in the state.

What is a Jurat?

A jurat is used when the signer is swearing to the content of the document. The notary must administer an oath or affirmation to the signer in order to complete the jurat.

What is the difference between an acknowledgment and a jurat?

What's the difference between a notary acknowledgment stamp and a jurat? Many people don't know the answer to this question, so here's a quick breakdown of each. A notary acknowledgment stamp is used to verify the signature on a document, while a jurat is used to swear that the information in a document is true.

What is a fee for a mobile notary in California?

Whether it's for Acknowledgments, Jurats, or Verbal Oath/Affirmations, the fee stands at $15 per signature in most cases. It's essential to note that this fee doesn't include travel expenses, rush hour, odd hour. If a Notary needs to travel to perform their services, they may charge an additional fee.

Can a notary public in California notarize foreign language documents?

As a general rule, California state laws allow a notary from notarizing foreign language documents. They can notarize documents even in cases where they are unable to read and write the foreign language of the documents presented. In this case  some form of valid photo ID is a must.
